Texas Health and Safety Code and Texas Water Code Settlement Notice
The State of Texas gives notice of the following proposed resolution of an environmental enforcement action under the Texas Health and Safety Code and the Texas Water Code. Before the State may enter into a voluntary settlement agreement, pursuant to section 7.110 of the Texas Water Code, the State shall permit the public to comment in writing. The Attorney General will consider any written comments and may withdraw or withhold consent to the proposed agreement if the comments disclose facts or considerations indicating that consent is inappropriate, improper, inadequate, or inconsistent with the requirements of the law.
Case Title and Court: Harris County, Texas and State of Texas v. Texas Materials Group, Inc.; Cause No. 2024-33239; in the 113th District Court of Harris County, Texas
Background: Texas Materials Group, Inc. ("TMG") owns and operates a concrete crushing facility in Houston, Texas ("Facility"). TMG is permitted by New Source Review ("NSR") Permit No. 136386. Over the course of two site visits conducted from March 2, 2022, to December 8, 2022, Harris County Pollution Control Services documented violations at the Facility including failure to control visible particulate matter emissions from the crushers and stacker using a functioning spray bar system; exceedance of authorized stockpile height; failure to clean or water paved surfaces to abate dust; and failure to maintain or produce records related to plant maintenance and monitoring. On May 24, 2024, Harris County filed suit against TMG for violations of the Texas Health and Safety Code, Texas Water Code, TCEQ rules, and NSR Permit No. 136836, naming the State as a necessary and indispensable party pursuant to Texas Water Code § 7.353.
Proposed Settlement: The State, Harris County, and TMG, propose an Agreed Final Judgment that awards the State and Harris County the following monetary judgments against TMG: $85,000.00 in civil penalties, with the penalties to be split evenly between Harris County and the State. The Agreed Judgment would also award $15,000.00 in attorney fees, to be split evenly between Harris County and the State, and $358.00 in court costs to Harris County.

Agreed Orders
The Texas Commission on Environmental Quality (TCEQ, agency, or commission) staff is providing an opportunity for written public comment on the listed Agreed Orders (AOs) in accordance with Texas Water Code (TWC), §7.075. TWC, §7.075 requires that before the commission may approve the AOs, the commission shall allow the public an opportunity to submit written comments on the proposed AOs. Notice of Costs to Administer the Voluntary Cleanup Program and the Innocent Owner/Operator Program
In accordance with Texas Health and Safety Code, §361.613 (pertaining to the Voluntary Cleanup Program (VCP)) and 30 Texas Administrative Code §333.43 (pertaining to the Innocent Owner/Operator Program (IOP)), the executive director of the Texas Commission on Environmental Quality (TCEQ or commission) annually calculates the commission's costs to administer the VCP and the IOP, and publishes in the Texas Register the rates established for the purpose of identifying the costs recoverable by the commission. The TCEQ has calculated, and is hereby publishing, the bill rate for both the VCP and the IOP as $138 per hour for the commission's Fiscal Year 2027.
The VCP and the IOP are implemented by the same TCEQ staff. Therefore, a single hourly bill rate for both programs is appropriate. The hourly bill rate is determined based upon current projections for staff salaries for Fiscal Year 2027, including the fringe benefit rate and the indirect cost rate, minus anticipated federal funding that the commission will receive, and then divided by the estimated number of staff hours necessary to complete the program tasks. Fringe benefits include retirement, social security, and insurance expenses and are calculated at a set rate for the entire agency. The current fringe benefit rate is 33.78% of the budgeted salaries. Indirect costs include allowable overhead expenses and are calculated at a set rate for the entire agency. The current indirect cost rate is 34.30% of the budgeted salary. The hourly bill rate was calculated and then rounded to the nearest whole dollar amount. After an applicant's initial $1,000 application fee has been depleted for the VCP or the IOP review and oversight costs, invoices will be sent monthly to the applicant, or designee, for payment.
The commission anticipates receiving federal funding during Fiscal Year 2027 for the continued development and enhancement of the VCP and the IOP. If the federal funding anticipated for Fiscal Year 2027 does not become available, the commission may calculate and publish a new hourly bill rate. Federal funding of the VCP and the IOP should occur prior to October 1, 2026.

Notice of Deletion of the Voda Petroleum, Inc. State Superfund Site from the State Superfund Registry
The Texas Commission on Environmental Quality (TCEQ) executive director (ED) is issuing this notice concerning the Voda Petroleum, Inc. state Superfund Site's (the site) deletion from the state Superfund registry (registry). The registry lists the contaminated sites which may constitute an imminent and substantial endangerment to public health and safety or the environment due to a release or threatened release of hazardous substances into the environment.
About the Site
The site, including all land, structures, appurtenances, and other improvements, is approximately 6.12 acres located at 711 Duncan Road, White Oak, Gregg County, about 1.25 miles west of the intersection of Farm-to-Market (FM) 2275 (George Richey Road) and FM 3272 (North White Oak Road), and approximately 500 feet north of the intersection of Duncan Road and Charise Drive, 2.6 miles north/northeast of the city of Clarksville City, Gregg County, Texas. The site also includes any areas where hazardous substances had come to be located as a result, either directly or indirectly, of releases of hazardous substances from the site.
Voda Petroleum operated as a waste-oil recycling facility from 1981 until its abandonment in 1991.
Remediation Activities and Public Meetings
This site had soil and groundwater contamination, which led to its proposed listing on the registry. The notice for the proposed listing appeared in the November 17, 2000, issue of the Texas Register (25 TexReg 11594), announcing the public meeting held on January 11, 2001, to receive comments.
The public notice concerning the proposed remedial action selection, appeared in the September 19, 2008, issue of the Texas Register (33 TexReg 8055). A public meeting was held on October 23, 2008, to receive comments on the proposed remedial action.
The remedial action consisted of excavation and off-site disposal of contaminated soil and the operation of an enhanced in-situ bioremediation system using reactive bio-barrier wells for on-site and off-site shallow groundwater. TCEQ soil excavation and groundwater data shows no contamination remains on site above Texas Risk Reduction Program rule Tier 1 residential protective concentration levels. Therefore, the site is protective of residential land use.
30 Texas Administrative Code §335.344(b) Delisting Public Meeting
The notice for the proposed delisting appeared in the Texas Register February 6, 2026, issue (51 TexReg 770), and in the Longview News Journal newspaper announcing the public meeting on March 12, 2026, to receive comments. The ED received and addressed all comments during the public meeting.
30 Texas Administrative Code (TAC) §335.344(c) Deletion Reason
TCEQ has performed remedial actions at the site and removed all equipment associated with the former waste oil recycling operations. The ED has determined that the site no longer presents an imminent and substantial endangerment to public health and safety and the environment. Therefore, the site is eligible for deletion from the registry.
Texas Health and Safety Code §361.188(d) Delisting Notice
TCEQ will file a notice in the Gregg County, Texas real property records about the site's deletion from the state registry.

TCEQ Internal Control No. D-07222026-064: WBW Single Land Investment, LLC - Series 150, (Petitioner), filed a petition for creation of Brazos County Municipal Utility District No. 7 (District) with the Texas Commission on Environmental Quality (TCEQ). The petition was filed pursuant to Article XVI, §59 of the Constitution of the State of Texas; Chapters 49 and 54 of the Texas Water Code; 30 Texas Administrative Code Chapter 293; and the procedural rules of the TCEQ. The petition states that: (1) the Petitioner holds a majority in value of the land to be included in the proposed District; (2) there are no lienholders on the property to be included in the proposed District; (3) the proposed District will contain approximately 96.87 acres located within Brazos County, Texas; and (4) the District is located entirely outside the corporate limits or extraterritorial jurisdiction of any city or town. The petition further states that the proposed District will: (1) design, construct, acquire, maintain, and operate a waterworks and sanitary sewer system for domestic and commercial purposes; (2) design, construct, acquire, improve, extend, maintain, and operate works, improvements, facilities, plants, equipment, and appliances helpful or necessary to provide adequate drainage for the District; (3) control, abate, and amend local storm waters or other harmful excesses of waters; (4) acquire, own, develop, construct, improve, manage, maintain, and operate roads or any improvement in aid of roads; and (5) design, construct, acquire, improve, maintain, and operate such additional facilities, systems, plants, and enterprises as shall be consonant with all of the purposes for which the proposed District is created. According to the petition, a preliminary investigation has been made to determine the cost of the project, and the Petitioner estimates the cost of said project will be approximately $17,170,000 ($12,520,000 for water, wastewater, and drainage plus $4,650,000 for roads).

The Texas Commission on Environmental Quality (TCEQ or commission) staff is providing an opportunity for written public comment on the listed Default Order (DO). Notice of Public Hearing on Proposed Amendments to 30 TAC Chapter 205
The Texas Commission on Environmental Quality (commission) will conduct a public hearing to receive testimony regarding proposed amendments to 30 Texas Administrative Code (TAC) Chapter 205, General Permits for Waste Discharges, §205.4 under the requirements of Texas Government Code, Chapter 2001, Subchapter B.
The rulemaking would amend 30 Texas Administrative Code (TAC) Chapter 205, General Permits for Waste Discharges. Specifically, it would revise §205.4 to clarify that: (1) the executive director shall deny authorization to discharge under an existing general permit if the discharger has an unsatisfactory compliance history rating; (2) once a discharger authorized under a general permit has been denied an authorization, the discharger is not eligible for a general permit again until the ED actively authorizes the discharger to use the general permit; and (3) an automated process cannot be used to approve an application under a general permit following the denial or suspension of an authorization.
The commission will hold a hybrid virtual and in-person public hearing on this proposal in Austin on September 28, 2026, at 10:00 a.m. in building E, Room 201S at the commission's central office located at 12100 Park 35 Circle. The hearing is structured for the receipt of oral or written comments by interested persons. Individuals may present oral statements when called upon in order of registration. Consideration of the application by 3T Martins Farm Hico, LLC and TMC Dairies LLC for a minor amendment of Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0003190000, for a Concentrated Animal Feeding Operation (CAFO), to authorize the applicant to reconfigure land management units (LMUs) #1A, #2 and #7A which will change the acreage of LMU #1A from 93 to 99 acres, LMU #2 from 39 to 32 acres, and LMU #7A from 33 to 24 acres; and remove LMU #8A - 18 acres and part of LMU #8 from land application and repurpose the area as the new location for the digester and renewable natural gas equipment along with an access road. The former location of the digester will be used as the digester solids processing location, which will decrease the acreage of LMU #8 from 26 to 15 acres and the total land application area from 1,028 to 989 acres. Ten new water wells with 150 foot buffers will be added to the site: TD14, TD15, TD16, TS11, TS12, TS13, TS14, TS15, TS16 and TS17. The calculations for the retention control structures (RCSs) have been revised, which will change the RCSs required capacities as follows: Phase 1: RCS TS1 - from 103.3 to 101.85 acre-feet (digester operational), RCS TD1 from 66.71 to 63.66 acre-feet, and RCS TS1 (digester on bypass) from 39.71 to 38.26 acre-feet; and Phase 2: RCS TS1 - from 148.14 to 146.69 acre-feet (digester operational), RCS TD1 from 63.31 to 44.71 acre-feet, and RCS TS1 (digester on bypass) from 39.71 to 38.26 acre-feet. The facility is located at 3618 County Road 540, Hico, Erath County, Texas 76457.

Consideration of the application by 3T Martins Farm Hico, LLC and TMC Dairies LLC for a minor amendment of Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0003190000, for a Concentrated Animal Feeding Operation (CAFO), to authorize the applicant to reconfigure land management units (LMUs) #1A, #2 and #7A which will change the acreage of LMU #1A from 93 to 99 acres, LMU #2 from 39 to 32 acres, and LMU #7A from 33 to 24 acres; and remove LMU #8A - 18 acres and part of LMU #8 from land application and repurpose the area as the new location for the digester and renewable natural gas equipment along with an access road. The former location of the digester will be used as the digester solids processing location, which will decrease the acreage of LMU #8 from 26 to 15 acres and the total land application area from 1,028 to 989 acres. Ten new water wells with 150 foot buffers will be added to the site: TD14, TD15, TD16, TS11, TS12, TS13, TS14, TS15, TS16 and TS17. The calculations for the retention control structures (RCSs) have been revised, which will change the RCSs required capacities as follows: Phase 1: RCS TS1 - from 103.3 to 101.85 acre-feet (digester operational), RCS TD1 from 66.71 to 63.66 acre-feet, and RCS TS1 (digester on bypass) from 39.71 to 38.26 acre-feet; and Phase 2: RCS TS1 - from 148.14 to 146.69 acre-feet (digester operational), RCS TD1 from 63.31 to 44.71 acre-feet, and RCS TS1 (digester on bypass) from 39.71 to 38.26 acre-feet. Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence Under the Texas Coastal Management Program
On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439 - 1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 26. Requests for federal consistency review were deemed administratively complete for the following project(s) on August 17, 2026. As required by federal law, the public is given an opportunity to comment on the consistency of proposed activities in the coastal zone undertaken or authorized by federal agencies. Pursuant to 31 TAC §§30.20(f), 30.30(h), and 30.40(e), the public comment period extends 30 days from the date published on the Texas General Land Office web site. The notice was published on the web site on Friday, August 21, 2026. The public comment period for this project will close at 5:00 p.m. on Sunday, September 20, 2026.
Federal License and Permit Activities:
Applicant: ST LNG
Location: The Proposed Action would be located in the U.S. Exclusive Economic Zone of the Gulf of America (GoA) approximately 10.4 nautical miles (19.2 kilometers) off the coast of Matagorda County, Texas in water depths between 65 and 72 feet. It would consist of fixed and floating components in Brazos Area Block (BA) 476 and a proposed 5.6-mile lateral pipeline in lease blocks BA-476, BA-449, and BA-450. The Proposed Action would not involve any new structures or improvements located onshore or "upstream" of the pipeline lateral interconnect with the existing Transco pipeline.
Project Description: The purpose of the Proposed Action is to construct, own, operate, and eventually decommission the ST LNG deepwater port terminal using domestic natural gas from multiple supply hubs in Texas (including, but not limited to, the Tres Palacios Gas Storage and Trading Hub and the Williams Markham Gas Processing Plant), utilize existing natural gas infrastructure to transport the gas offshore, liquefy the gas, and export up to 8.4 Million Metric Tons Per Annum as Liquefied Natural Gas (LNG) via an offshore Deepwater Port (DWP) to Free-Trade Agreement (FTA) and non-FTA nations.
The Proposed Action would consist of four phases. Each phase would include five fixed offshore platforms (Gas Treatment, Liquefaction, Bridge Support Trestle, LNG Transfer, and Accommodation and Utilities), bridges linking each platform, a dolphin mooring system composed of three berthing dolphins and six mooring dolphins, and a moored LNG Floating Storage Unit (FSU). At full build-out, the Proposed Action would include 20 platforms, 4 FSUs, 4 mooring systems, and 7.7 miles of pipeline (a 5.6-mile lateral pipeline, and 2.1 miles of interconnecting pipelines between each phase. The platforms of each individual phase would be connected via a series of linking bridges; however, the four phases of the Proposed Action would stand independently of one another, separated by approximately 2,260 feet, and would be capable of functioning independently.
To facilitate the necessary feed gas for the Project, ST LNG anticipates obtaining natural gas from the Tres Palacios Natural Gas Storage and Trading Hub and the Williams Markham Gas Processing Plant through an existing Transco 36-inch-diameter pipeline that is approximately 5.6 miles northeast of the DWP site. Once the natural gas has been transported to the DWP, the gas would be processed, liquefied, and stored in the FSUs. From the FSUs, the LNG would be loaded onto LNG carriers (LNGCs) with cargo capacities between 125,000 and 180,000 cubic meters (m3). A maximum of 25 LNGCs would be loaded per year for each phase of the Project, totaling 100 LNGCs annually for the DWP. The LNGCs would export the LNG to FTA and non-FTA nations. While associated with the Project, the Applicant would not have control over the visiting LNGCs, except for contracting them to transport the LNG.
The Proposed Action would not involve any new structures or improvements located onshore or "upstream" of the pipeline lateral interconnect with the existing Transco pipeline. While exact locations of fabrication yards are not currently identified by ST LNG, fabrication activities would occur at existing facilities in Texas and/or Louisiana. The ST LNG team office would be located on site at the fabrication yards. During operation, the onshore ST LNG team would be based near the Calhoun Port Authority site in Point Comfort, Texas, using existing buildings and vessel berths. No new or modified onshore facilities are included in the Proposed Action.
If approved, construction of each phase of the Proposed Action would be staggered by 18 months for ease of constructability: Phase 2 on-site construction would start 18 months after the start of Phase 1 on-site construction, Phase 3 on-site construction would start 18 months after the start of Phase 2 on-site construction, and Phase 4 on-site construction would start 18 months after the start of Phase 3 on-site construction. The Project is proposed to have a 25-year life span for each phase (approximately 30 years in operation), and each phase would be decommissioned independently. The Applicant would comply with the environmental regulations applicable at the time of decommissioning to minimize impacts on the natural and social environment. The type and severity of impacts may need to be reevaluated at the time of decommissioning to account for changes between the time the final Environmental Impact Statement (EIS) is published and the time the Project is decommissioned that would affect the natural or social environment.

The Texas Higher Education Coordinating Board (THECB) published proposed amendments to 19 TAC §§4.81 - 4.87, and new §4.88 in the August 7, 2026, issue of the Texas Register (51 TexReg 5059). Due to an error by the agency, the proposed amendments for §4.85(b)(1) and (b)(2) were published incorrectly. The correct proposed amended text should read as follows:

Introduction
Texas Labor Code §405.0026 requires the Workers' Compensation Research and Evaluation Group (REG) to prepare a research agenda each year for the commissioner to review, approve, and publish in the Texas Register.
Texas Labor Code §405.0025 requires the REG to conduct professional studies and research related to how effectively the workers' compensation system operates.
Texas Insurance Code §1305.502 requires the REG to develop and issue an informational report card each even-numbered year that objectively identifies and compares certified health care networks with each other and with claims outside of those networks.
Proposed Fiscal Year 2027 Research Agenda
The REG proposes the following research projects:
1. An update of the study to estimate employer participation in the Texas workers' compensation system.
2. An update of injured employee access to medical care provided under the workers' compensation system, including an analysis of access to medical care through TDI-certified workers' compensation health care networks.
The REG will consider expanding the scope of the research projects or conducting more projects to accommodate stakeholder suggestions, subject to the resources and data available.
